The So-Called “FACT Act” Will Deny Compensation to People Suffering from Asbestos Cancers.
The “Furthering Asbestos Claim Transparency Act” or “FACT Act” is not about facts or transparency. If it were, the so-called transparency rules would also apply to asbestos companies. This is one-way transparency – it applies to sick patients and their families, and to nobody else. The real goal of this bill is to afford defendant companies legal tricks to deny even more compensation to asbestos victims. Why else would the Koch Brothers’ Georgia-Pacific, Exxon Mobil and Dow Chemical be working so hard to pass legislation like this in Congress and in states across the country? Since at least the 1930’s, asbestos companies and their insurers have been denying responsibility for the millions of deaths and injuries caused by this deadly product. They have hidden the dangers, lied that they didn’t know about those dangers, lobbied to make it harder for victims who deserved to get compensation, weakened protective legislation, and continuously denied responsibility.
